What is negligence?

Negligence is essentially the failure to act as a reasonably prudent person would under similar circumstances. It's a legal concept in personal injury law. In all personal injury cases, you have to prove that a party was negligent before you could see compensation from them, and negligence requires that first there's a duty and then that you prove that there was a breach of that duty, whether by action or in action.
